Acceptable Use Policy (AUP)

1. Introduction and Scope
This Acceptable Use Policy ("AUP" or "Policy") establishes the rules, restrictions, and standards governing access to and use of the Bitprime platform (bitprime.io). The platform is operated by MBI.COM Spółka z ograniczoną odpowiedzialnością, a company incorporated in Poland. The Company operates under a transaction execution (transit) model. The Company does not maintain client accounts or balances; any handling of crypto-assets is temporary and strictly limited to transaction execution. The Company does not provide custodial services and does not maintain ongoing control or storage of client assets.
2. Definitions
- Digital Assets: Cryptocurrencies or tokens supported by Bitprime for the purpose of transaction execution.
- Fiat Currency: Refers exclusively to the Euro (EUR).
- User / You: Any individual or legal entity accessing the Services.
- User Profile: A registered profile enabling access to Services (formerly "Account"). Please note: The Company does not maintain user accounts with stored balances.
3. Compliance With Laws
Users must comply with all applicable laws and regulations in their jurisdiction. The Company operates a hybrid AML framework combining automated tools (such as Sumsub) and internal compliance oversight by Transaction Monitoring (TM) specialists and the MLRO to prevent financial crime, money laundering (AML), and terrorist financing (CTF).
4. Prohibited Activities
Users are strictly prohibited from using the Services for:
- 4.1 Financial Crime: Money laundering, bribery, tax evasion, or fraud.
- 4.2 Fraudulent Conduct: Identity theft or providing false information during KYC/AML procedures.
- 4.3 Market Manipulation: Wash trading, spoofing, or pump-and-dump schemes.
- 4.4 Illegal Goods: Transactions involving firearms, narcotics, or counterfeit goods.
- 4.5 Human Exploitation: Human trafficking, forced labor, or exploitation.
5. High-Risk Cryptocurrency Activities
Users are prohibited from using Services in connection with mixers, tumblers, darknet marketplaces, or ransomware payments. The Company does not retain funds beyond execution and reserves the right to block transactions associated with high-risk blockchain activity.
6. Restricted Businesses
Without prior written approval, Services may not be used for unlicensed gambling, adult content, shell banks, or money service businesses in high-risk jurisdictions.
7. Fiat Transaction Rules (EUR → Crypto Only)
- 7.1 Third-Party Payments: Users must only use payment methods belonging to the verified profile holder. Funding using third-party accounts is strictly prohibited.
- 7.2 Execution Flow: The Company relies on third-party liquidity providers for execution and does not act as a principal trading counterparty. Funds pass through the Company's infrastructure only for immediate transaction delivery.
8. Blockchain Monitoring and Transaction Screening
The Company reserves the right to monitor all transactions using blockchain analytics to identify suspicious activity or illicit funds. The Company may block, delay, or cancel transactions based on risk assessment.
9. Sanctions Compliance
Users in jurisdictions subject to international sanctions (EU, UN, OFAC) may not access Services. Bitprime reserves the right to terminate access where sanctions risks are identified.
10. Platform Security
Users may not attempt to compromise the platform through hacking, reverse engineering APIs, deploying malware, or launching DDoS attacks.
11. Geographic Restrictions
Bitprime Services are not available in all jurisdictions. Users must not circumvent geographic restrictions through VPNs, proxy servers, or Tor networks.
12. Enforcement and Risk Positioning
Bitprime may take enforcement action, including profile termination or blocking of transactions. Our risk positioning ensures no long-term exposure and no proprietary use of client funds during the transit process.
13. User Conduct
Users must treat Bitprime employees and support staff respectfully. Abusive or threatening behavior will result in immediate termination of the User Profile.
14. Digital Asset Risks
Digital asset transactions are irreversible once confirmed on the blockchain. Users are solely responsible for verifying transaction details. The Company does not provide custodial services, and assets remain in your personal external wallet.
15. Indemnification
Users agree to indemnify Bitprime from claims, damages, or losses arising from Policy violations or unlawful activity conducted through their profile.
16. Amendments
Bitprime reserves the right to modify this Policy at any time. Updated versions become effective immediately upon publication on the website.
17. Governing Law
This Policy shall be governed by the laws of the Republic of Poland. Any disputes shall be subject to the jurisdiction of the competent courts of Poland.
